This Site Terms of Use should be read together with our Privacy Policy and Credit Report Terms of Use — collectively, the "Agreement" between you and Upshift Services Pvt Ltd (together with its partners and group companies, "we", "us" or "our").

This document is published in compliance with the Information Technology Act, 2000 (as amended from time to time) and all other applicable laws, guidelines, rules and regulations.

The services rendered by us are exclusively intended for individuals who are citizens of India, residing in India, and above 18 years of age. By accessing our site and/or using the information provided on or via it, you agree to these terms of use. If you do not agree, you should not access, visit, or use the site or avail our services.

"Affiliates" means, in relation to any person, any entity that directly or indirectly controls, is controlled by, or is under common control with, that person, where "control" has the meaning assigned to it in the Companies Act, 2013, as amended.

"Applicable Laws" includes any applicable constitution, statute, law, rule, regulation, ordinance, decree, order, judgement, authorisation, or any directive, guideline or government restriction having the force of law, within the jurisdiction of India, as amended from time to time.

"Bureau" means a credit information company authorised under Indian law to provide comprehensive credit information by collecting, collating and issuing credit information — pertaining to both commercial and consumer borrowers — to a closed user group of members.

"Partner" means banks, non-banking financial institutions, housing finance companies, insurance companies, fintech companies, Bureaus and other financial institutions regulated by the RBI, SEBI or IRDAI, with whom we have an arrangement to offer their products on the site.

"Site" means any website, mobile site, or application owned and operated by us. "Service" means our products, software and services available on the site, and any products offered by our Partners on the site. "Service Provider" means any authorised service provider engaged by us to help offer Services on the site.

"You", "your" or "User" means anyone who visits, accesses, or uses our site, or obtains Services from us through it.

By using this site, you confirm that you are a resident of India, at least 18 years old, legally entitled to enter into a binding contract, and not a person barred from receiving services under applicable Indian law. You confirm you will only use the site to make legitimate transactions for yourself or for another person you are legally authorised to act for, and that all statements, answers and information you give us are true and complete.

You authorise us and our Partners to share the information you provide, or that we obtain as a result of your application, with third parties including Service Providers, Bureaus and statutory bodies as necessary, and agree not to hold us or our Partners liable for that use or sharing.

You confirm you have read the applicable terms and conditions, including fees and charges, for any financial product you wish to avail, as disclosed on the site or by the relevant Partner. You acknowledge that approval, credit limit and terms for any loan, credit card, insurance or financial product are at the sole discretion of the Partner, and that we make no representation or commitment regarding approval or rejection.

You agree that interest rates, fees and prices shown on the site may vary and are ultimately determined by the Partner; the EMI calculators on the site are self-help planning tools only, may be subject to error, and should be independently verified before you rely on them.

You acknowledge that any pre-qualified or pre-approved offer shown to you, based on your relationship with us or our Partners, does not constitute a commitment or guarantee of any financial product. Any decision to apply is at your own risk, and you agree to hold us harmless for any resulting loss or damage.

You consent to receiving communications about customised recommendations, promotional offers and other products or Services via email, SMS, WhatsApp, phone call or app notification, even if you are registered under NCPR/NDNC or any other TRAI-prescribed registry.

The display of a Partner's products on the site does not imply any sponsorship, recommendation or approval by us of that Partner or its products, and we are not responsible for the accuracy, timeliness or completeness of information we obtain from Partners. Your interaction with any Partner accessed through the site is at your own risk.

By consenting to our Credit Report Terms of Use, you authorise us to collect, receive and access your credit information report or score, and other related information, from credit information companies ("CICs") registered under the Credit Information Companies (Regulation) Act, 2005, and to act as your lawfully appointed agent for that purpose. We have no control over the content or accuracy of information provided by CICs.

You authorise us to obtain your financial information from financial information providers via an Account Aggregator platform, where you choose to use that Service. This consent is valid for up to 24 months unless you revoke it earlier. Where you use our Personal Finance Manager ("PFM") Service, you understand the resulting summary report is for informational purposes only, is not investment advice, and that we are not liable for its accuracy.

You agree to indemnify, defend and hold harmless Upshift Services Pvt Ltd, its Affiliates, and their directors, officers, employees, agents, Partners and Service Providers from and against any losses, liabilities, claims, damages, costs and expenses (including legal fees) arising out of, or resulting from, any breach or non-performance by you of these Site Terms of Use.

Content on this site is provided for general information only and should not be used as a basis for business or commercial decisions.
